In such cases, you should:<\/p><p>o brace the wall as soon as possible to prevent danger or further damage; and<\/p><p>o hire a registered Structural Engineer or a qualified contractor to advise on the best approach.<\/p><p>You do not need to contact the Department of Planning to carry out emergency bracing, however all necessary approvals should be obtained, or you should obtain written confirmation from the Department that no applications are required, before a wall is constructed, replaced or altered. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1a57018 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1a57018\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-4144c2f\" data-id=\"4144c2f\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-a2ac7bf elementor-widget elementor-widget-heading\" data-id=\"a2ac7bf\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">What Type of Application Do I Need?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-c3d8044 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"c3d8044\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-4332184\" data-id=\"4332184\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-e3b95cc elementor-widget elementor-widget-text-editor\" data-id=\"e3b95cc\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>\u2705 Retaining walls no higher than 4 Feet (48\u201d) above the adjacent grade and the replacement of a retaining wall of any height are normally considered \u2018permitted development\u2019 under the Development and Planning (General Development) Order 1999 (the \u2018GDO\u2019). Therefore, you do not need to obtain full planning permission unless:<\/p><p>o your property is listed;<\/p><p>o your property is located within a Historic Protection Area;<\/p><p>o the wall is located within a Conservation Zone (i.e. a Woodland Reserve or Agricultural Reserve);<\/p><p>o the wall would be located within a Nature Reserve or Coastal Reserve Conservation Base Zone; or<\/p><p>o in the case of replacements, more than 60% of the original volume of the structure has been destroyed.<\/p><p>The Department of Planning\u2019s <a href=\"https:\/\/bdagov.maps.arcgis.com\/apps\/webappviewer\/index.html?id=bc5f33868b724838a4e9c875c24d836f\">zoning map<\/a> can be used to ascertain the above. Other than the exceptions noted above, you will need to apply for either a Residential or Commercial Permitted Development Permit (PDP), depending on your property type. A PDP may be submitted for repairs and minor alterations even for the exceptions noted above in some cases; the Department of Planning should be consulted in such instances as each case must be considered on its own merits in respect of whether the proposal would pose any material impacts.<\/p><p>\u26a0\ufe0f New retaining walls over 4 Feet (48\u201d), as well as any wall which falls within one of the four categories set out above and cannot be approved via the PDP process, will require:<\/p><p>o A planning application, and<\/p><p>o A building permit if planning permission is granted.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-f2c3cae elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"f2c3cae\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-90e6d52\" data-id=\"90e6d52\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-e47a2d0 elementor-widget elementor-widget-heading\" data-id=\"e47a2d0\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Design Recommendations<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2bf560b elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2bf560b\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-958038b\" data-id=\"958038b\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-099b756 elementor-widget elementor-widget-text-editor\" data-id=\"099b756\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Regardless of the size of the retaining wall, it is important to ensure that it is properly designed so that it is structurally sound and does not pose detrimental impacts on the appearance of an area of the amenity of neighbouring properties.<\/p><p>Residential retaining walls under 8 feet which are not supporting roads or other infrastructure should be designed in accordance with Chapter 5 of the Bermuda Residential Building Code 2014\/25 (BRBC). If your design does not follow the BRBC, a Structural Engineer will need to be appointed to provide a custom solution and confirm the structural integrity of the wall.<\/p><p>Retaining walls over 8 feet, walls on commercial property or retaining walls supporting a road or other infrastructure must include drawings which are approved by a registered Structural Engineer.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section the retaining wall is a part of a larger project, submission drawings, details and specifications should follow the guidance set out in Section 34 \u2013 Appendix A of the Bermuda Residential Building Code 2014\/25.<\/p><p>Building permit applications proposing only a retaining wall must include the following (drawings shown are for illustrative purposes
