Pre-Consultations<\/span><br \/><span style=\"color: #000000;\">2. Planning Permission<\/span><br \/><span style=\"color: #000000;\">3. Foreshore Lease<\/span><br \/><span style=\"color: #000000;\">4. Building Permit<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-4faabd2 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"4faabd2\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-5b1982c\" data-id=\"5b1982c\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-c8e18db elementor-widget elementor-widget-heading\" data-id=\"c8e18db\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Pre-Consultations<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-a568a5c elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"a568a5c\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-30759d3\" data-id=\"30759d3\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-ab02c47 elementor-widget elementor-widget-text-editor\" data-id=\"ab02c47\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #000000;\">Prior to submitting a planning application, a completed Foreshore Lease Application Form together with a copy of the drawings to be submitted with the planning application must be submitted to the Estates section at<\/span> <a href=\"mailto:estates@gov.bm\">estates@gov.bm<\/a>. <span style=\"color: #000000;\">A planning application cannot be submitted until the Estates section has confirmed, in writing, that it is aware of the proposal. A response will typically be issued within 5 business days.<\/span><\/p><p><span style=\"color: #000000;\">If a foreshore lease is currently in place, a copy of this together with written confirmation from the Estates section that it is aware of the current proposal should be included with the planning application.<\/span><\/p><p><span style=\"color: #000000;\">It is also strongly recommended that pre-consultations be sent to the<\/span> <a href=\"mailto:smanuel@gov.bm\">Marine Conservation<\/a> <span style=\"color: #000000;\">section of the Department of Environment and Natural Resources, who will provide feedback on potential impacts on the marine environment, including whether any protected species may be affected, and the<\/span> <a href=\"mailto:kswoodley@gov.bm\">Marine and Ports<\/a> <span style=\"color: #000000;\">section of the Ministry of Public Works, who will advise on impacts to marine traffic.<\/span><\/p><p><span style=\"color: #000000;\">Foreshore development should be designed in accordance with the relevant policies of the<\/span> <a href=\"https:\/\/bdagov.maps.arcgis.com\/apps\/MapJournal\/index.html?appid=955c05f85d674521bc0813299f13d276\">Bermuda Plan 2018<\/a>, <span style=\"color: #000000;\">in particular those set out in Chapter 11.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-4adf89a elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"4adf89a\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-76e6dff\" data-id=\"76e6dff\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-023d787 elementor-widget elementor-widget-heading\" data-id=\"023d787\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Planning Permission<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2596faa elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2596faa\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-f994d9b\" data-id=\"f994d9b\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-1bfa318 elementor-widget elementor-widget-text-editor\" data-id=\"1bfa318\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #000000;\">An application for planning permission for any development which affects the seabed beyond the mean high water mark will be rejected unless the application includes written acknowledgement from the Estates section confirming that it is aware of the proposal for which planning permission is being sought. In addition to such confirmation, the planning application must include all relevant information as detailed in the<\/span> <a href=\"https:\/\/planning.gov.bm\/index.php\/guide-to-submitting-planning-applications\/\">Guide to Submitting Planning Applications<\/a> <span style=\"color: #000000;\">together with details of any pre-consultation responses which have been received.<\/span><\/p><p><span style=\"color: #000000;\">Planning applications are assessed against the relevant policies of the<\/span> <a href=\"https:\/\/bdagov.maps.arcgis.com\/apps\/MapJournal\/index.html?appid=955c05f85d674521bc0813299f13d276\">Bermuda Plan 2018<\/a> <span style=\"color: #000000;\">and, unless such consultation responses are included in the planning application, the Department of Planning will consult the Marine Resources Board and the Marine and Ports section on all applications which propose development beyond the high water mark.<\/span><\/p><p><span style=\"color: #000000;\">Planning permission for foreshore development will typically include a condition requiring a foreshore lease agreement to be included with the building permit application.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-238d9f1 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"238d9f1\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-04e9397\" data-id=\"04e9397\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-93493f6 elementor-widget elementor-widget-heading\" data-id=\"93493f6\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Foreshore Lease<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-e1b390e elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"e1b390e\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-ec72c33\" data-id=\"ec72c33\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-93af873 elementor-widget elementor-widget-text-editor\" data-id=\"93af873\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #000000;\">Prior to submitting a building permit, a foreshore lease agreement with the Estates section of the Ministry of Public Works must be in place. This agreement will typically require the leaseholder to seek and obtain statutory consents, including a building permit. However, a building permit for any development which affects the seabed beyond the mean high water mark will be rejected unless the application includes an executed foreshore lease agreement with the Estates section of the Ministry of Public Works.<\/span><\/p><p><span style=\"color: #000000;\">Building permit applications are assessed against the relevant Building Code, which can be found<\/span> <a href=\"https:\/\/planning.gov.bm\/index.php\/building-codes\/\">here<\/a>. <span style=\"color: #000000;\">The building permit will be issued once all relevant drawings, specifications and associated documentation has been submitted to an appropriate degree of accuracy, which will allow construction to commence.
