An SDO may:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-7993aa3 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"7993aa3\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-9855fe9\" data-id=\"9855fe9\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-e782c80 elementor-widget elementor-widget-text-editor\" data-id=\"e782c80\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>\u2022 grant planning permission for a specific development or class of development; or<\/p><p>\u2022 allow the Development Applications Board (\u201cthe Board\u201d) the discretion to grant planning permission for development which it could not approve under the provisions of the relevant development plan.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-c6e7bb9 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"c6e7bb9\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-b250ff0\" data-id=\"b250ff0\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-ca70797 elementor-widget elementor-widget-heading\" data-id=\"ca70797\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Principles for Making a Special Development Order<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-bb9ba98 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"bb9ba98\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-e550c12\" data-id=\"e550c12\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-85a9d9b elementor-widget elementor-widget-text-editor\" data-id=\"85a9d9b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>SDOs may only be made for projects deemed to be of national significance and importance which cannot be approved by the Board under the usual planning application process.<\/p><p>Projects which are not considered to be of national significance and importance must follow the usual planning application process even if they cannot be approved by the Board; the Act allows any decision made by the Board to be appealed to the Minister.<\/p><p>An SDO may only be made by the Minister, however any person can submit a request to the Minister to make an SDO, as detailed below. All SDOs are subject to the scrutiny of the Legislature via the negative resolution procedure under section 8 of the <a href=\"https:\/\/www.bermudalaws.bm\/Laws\/Consolidated%20Law\/1977\/Statutory%20Instruments%20Act%201977\">Statutory Instruments Act 1977<\/a>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-754bd42 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"754bd42\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-252451a\" data-id=\"252451a\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-029510a elementor-widget elementor-widget-heading\" data-id=\"029510a\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Procedure for Requesting a Special Development Order<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-95e22d7 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"95e22d7\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-6dfa4e5\" data-id=\"6dfa4e5\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-a13308b elementor-widget elementor-widget-text-editor\" data-id=\"a13308b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The steps set out below must be followed in all cases in order to make a request to the Minister to make an SDO. This procedure is intended to ensure that an appropriate level of information is provided, proper public consultation is carried out and comprehensive technical assessments are made in order to allow the Minister to make a fully informed decision.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2894dc1 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2894dc1\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-f4711db\" data-id=\"f4711db\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-3f6bbdc elementor-widget elementor-widget-heading\" data-id=\"3f6bbdc\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Step 1: Environmental Impact Statement Screening\/Scoping<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-d08b9a3 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"d08b9a3\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-2209a39\" data-id=\"2209a39\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-233ee1a elementor-widget elementor-widget-text-editor\" data-id=\"233ee1a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In order for an SDO to be considered, either an \u201cEnvironmental Impact Assessment Screening\u201d or \u201cEnvironmental Impact Assessment Scoping\u201d pre-consultation, as detailed in the Department\u2019s <a href=\"https:\/\/planning.gov.bm\/wp-content\/uploads\/2018\/11\/GN106-Environmental-Impact-Assessment.pdf\">Environmental Impact Assessments and Environmental Impact Statements Guidance Note<\/a>, must first be submitted via the Department\u2019s <a href=\"https:\/\/planning.gov.bm\/index.php\/customer-self-service\/\">Customer Self Service (CSS) portal<\/a>. A Screening should be submitted if confirmation is required as to whether an Environmental Impact Statement (EIS) will be needed; if it is clear that an EIS will be needed a Screening should be included with the pre-consultation in order to inform the contents of the subsequent EIS, including details of the public consultation which the developer will be carrying out prior to the completion of the final EIS.<\/p><p>Other Government departments will typically be consulted and the Minister will be informed of the submission, however pre-consultations are not subject to public consultation and are not made available to members of the public.<\/p><p>A formal response will be provided by the Department and the entire pre-consultation file will be forwarded by the Department to the Minister for information.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-428d268 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"428d268\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-e085ed0\" data-id=\"e085ed0\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-61cbb78 elementor-widget elementor-widget-heading\" data-id=\"61cbb78\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Step 2: Request for Minister to make a Special Development Order<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-5e2a95b elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"5e2a95b\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-1d16fa4\" data-id=\"1d16fa4\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-913741a elementor-widget elementor-widget-text-editor\" data-id=\"913741a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Once the Department has provided its pre-consultation response, the applicant may proceed with a formal request for the Minister to make an SDO, which must be submitted via the Department of Planning\u2019s <a href=\"https:\/\/planning.gov.bm\/index.php\/customer-self-service\/\">CSS portal<\/a>.<\/p><p>To make the submission, log in or create an account for the CSS portal, open the pre-consultation case, select the \u201cSub-Records\u201d tab then select \u201cApply\u201d alongside \u201cSpecial Development Order\u201d. Then follow the steps of the online form. Please note that only those who have been added as \u201cContacts\u201d to the pre-consultation case may make the submission.<\/p><p>All such submissions must include all of the items listed below At least one close-distance photograph of each site notice must be included so the text on the notice is easily legible and at least one photograph of each site notice from a far distance (i.e. at least a typical road width away) must be provided so the location of the displayed notice within the context of the local area can be clearly identified.<\/p><p>Once appropriate photographs of the notices and map of their location have been provided, the proposal will be published in the online <a href=\"https:\/\/www.gov.bm\/theofficialgazette\/notices\">Official Gazette<\/a> within five (5) business days. Such advertisements may be published on any business day.<\/p><p>Lists of applications published in the Official Gazette are also published on the Department of Planning\u2019s website and Facebook page.<\/p><p>Any person may submit comments on the submission, regardless of whether they would be directly impacted by the proposal. Comments may be submitted in the form of a formal objection or as a \u2018representation\u2019.
